1 Legal Entity & Agreement

This website and all services provided herein are operated by FashionIntel ("we", "us", "our"). By creating an account, subscribing to our services, or using any features of FashionIntel, you ("user", "you", "your") enter into a legally binding agreement with FashionIntel under these Terms and Conditions and our Privacy Policy.

You must be at least 18 years old to use FashionIntel. By using our service, you represent and warrant that you meet this age requirement and have the legal capacity to enter into this agreement.

2 Service Description

FashionIntel is an AI-powered fashion trend forecasting platform that provides data-driven insights to help fashion businesses, designers, and entrepreneurs make informed decisions about upcoming trends.

What We Offer:

• Trend Forecasting: AI-generated predictions for fashion keywords and products across multiple regions
• Regional Analysis: Insights tailored to specific geographic markets worldwide
• Category Filtering: Focused predictions by fashion category (clothing, accessories, footwear, etc.)
• Historical Comparison: Current trend levels vs. predicted future performance
• Confidence Metrics: Data quality indicators and prediction reliability scores (Premium feature)
• Dashboard Analytics: Comprehensive history and analysis of your past predictions (Premium feature)

Free Plan Includes:

• 3 trend predictions per month
• Access to basic AI forecasting model
• Global trend analysis (all regions combined)
• 30-day rolling prediction limit reset

Premium Plan Includes:

• Unlimited predictions with no monthly restrictions
• Advanced AI forecasting models with higher accuracy
• Region-specific analysis for any country/market
• Confidence scores and time-to-act recommendations
• Full dashboard access with prediction history and analytics
• Priority support and feature updates
• Price: €20/month, billed monthly through Paddle

3 User Account & Responsibilities

To use FashionIntel, you must create an account by providing accurate and complete information.

You Are Responsible For:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Immediately notifying us of any unauthorized use of your account
• Ensuring your contact information (especially email) is current and accurate
• Complying with all applicable laws and regulations when using our service

Prohibited Activities:

You agree NOT to:

• Create multiple accounts to circumvent free plan limitations
• Share your Premium account with others
• Scrape, copy, or redistribute our data or predictions without permission
• Reverse-engineer, decompile, or attempt to extract our algorithms or source code
• Use our service for any illegal or fraudulent purposes
• Attempt to gain unauthorized access to our systems or other users' accounts
• Overload or interfere with the proper functioning of our platform
• Use automated tools (bots, scripts) to access the service without explicit permission

4 Payments & Billing

All payments for FashionIntel Premium are processed securely through Paddle, our trusted payment processor. We do not store your credit card information on our servers.

Subscription Details:

• Price: €20 per month
• Billing Cycle: Monthly, recurring automatically until cancelled
• Payment Methods: Credit/debit cards, PayPal (via Paddle)
• Currency: Euro (EUR)

Subscription Management:

• You can cancel your subscription at any time from your Profile page
• Cancellation takes effect at the end of your current billing period
• You retain Premium access until the end of your paid period
• No partial refunds are given for unused time within a billing period
• After cancellation, you automatically revert to the Free plan

Price Changes:

We reserve the right to change our pricing at any time. If we increase prices, existing subscribers will be notified at least 30 days in advance. Price changes only affect renewals; your current billing period remains at the original price.

Failed Payments:

If a payment fails (expired card, insufficient funds, etc.), Paddle will attempt to retry the charge. If payment cannot be processed after multiple attempts, your Premium subscription will be cancelled, and you will lose access to Premium features.

5 Refund Policy

We offer a 14-day money-back guarantee on your first Premium subscription purchase only.

Refund Eligibility:

• Request must be made within 14 days of your initial subscription purchase
• Only your first payment is eligible; renewal payments are not refundable
• Only one refund per user account (lifetime limit)
• No evidence of service abuse or excessive usage

How to Request a Refund:

Simply go to your Profile page and click the "Request Refund" button (visible only during the 14-day window). Provide a brief reason, and we'll process your refund immediately.

6 Intellectual Property Rights

All content, features, functionality, algorithms, branding, logos, and design of FashionIntel are owned by FashionIntel and protected by international copyright, trademark, and other intellectual property laws.

What You Cannot Do:

• Copy, modify, or create derivative works of our platform or content
• Publicly display, perform, or distribute any part of our service
• Use our branding, logos, or trademarks without written permission
• Resell, sublicense, or commercialize access to FashionIntel

Your Data:

You retain ownership of any data you input into FashionIntel. By using our service, you grant us a license to process your data solely for the purpose of providing and improving our services.

7 Data & Privacy

Your privacy is important to us. We collect and use your personal information as described in our Privacy Policy, which is incorporated into these Terms by reference.

What We Collect:

• Account information (name, email, username)
• Usage data (predictions made, features used, timestamps)
• Payment information (handled securely by Paddle; we only store transaction IDs)

How We Use Your Data:

• To provide and improve our forecasting service
• To manage your account and subscription
• To send important service updates and notifications
• To analyze usage patterns and improve our algorithms

We will never sell your personal information to third parties.

8 Limitation of Liability

FashionIntel provides trend forecasting insights, but we cannot guarantee their accuracy or your success based on them.

We Are NOT Liable For:

• Business decisions made based on our predictions
• Financial losses resulting from trend forecasts
• Inaccurate or outdated data from external sources (e.g., Google Trends)
• Service interruptions, downtime, or technical issues
• Loss of data due to technical failures (though we maintain regular backups)
• Indirect, incidental, consequential, or punitive damages

Use at Your Own Risk: Fashion forecasting is inherently uncertain. You should conduct your own research and due diligence before making any business decisions. FashionIntel is a tool to inform your strategy, not a replacement for professional judgment.

9 Service Availability & Changes

We strive to keep FashionIntel available 24/7, but we cannot guarantee uninterrupted service.

We May:

• Temporarily suspend the service for maintenance or upgrades
• Modify, add, or remove features at any time
• Change the design, functionality, or interface of the platform
• Update our AI models and algorithms to improve accuracy

We'll notify users of significant changes via email or platform announcements. If changes materially affect your use of Premium features, we'll provide reasonable notice.

10 Account Termination

Either you or we may terminate your account at any time.

You Can:

• Cancel your subscription and downgrade to Free at any time
• Delete your account by contacting support at bushatibrigli@gmail.com

We May Suspend or Terminate Your Account If:

• You violate these Terms and Conditions
• You engage in fraudulent or abusive behavior
• Your payment fails repeatedly
• We receive legal orders requiring account termination
• We decide to discontinue the service (with reasonable notice)

11 Dispute Resolution

We hope to resolve any disputes amicably. If you have a concern, please contact us first at bushatibrigli@gmail.com. We'll make every effort to address your issue.

Governing Law:

These Terms are governed by the laws of Albania, without regard to conflict of law provisions. Any legal disputes will be resolved in the courts of Albania.

Arbitration (Optional):

If we cannot resolve a dispute informally, both parties agree to first attempt mediation before pursuing litigation.

12 Changes to Terms

We may update these Terms and Conditions from time to time to reflect changes in our service, legal requirements, or business practices.

How We Notify You:

• We'll update the "Last Updated" date at the top of this page
• For significant changes, we'll send an email notification
• Continued use of FashionIntel after changes constitutes acceptance

If you disagree with updated terms, you may cancel your subscription and stop using the service.

13 Miscellaneous

Entire Agreement:

These Terms, together with our Privacy Policy and Refund Policy, constitute the entire agreement between you and FashionIntel regarding use of our service.

Severability:

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

No Waiver:

Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision.

Assignment:

You may not transfer or assign your rights under these Terms. We may assign our rights to any affiliate or successor.
